A 10-year-old girl was allegedly forced to urinate into a cup aboard a moving school bus filled with middle-school-age kids in her southwest suburban Chicago school, prompting her parents to sue to district.
On Tuesday, Todd and Lisa Holmes of Wilmington, Ill. filed a lawsuit against Wilmington School District 209U and Wilmington Middle School, among others.
The suit claims their daughter — listed as "Jane Doe" in the filing — was humiliated and suffered "extreme emotional distress" from the incident, reports the Joliet Herald-News.
The Cook County Circuit Court lawsuit seeks more than $150,000 in damages for three counts of emotional distress. WGN reports school officials have not commented on the lawsuit.
The family's attorney Telly Nakos told the Sun-Times the girl asked multiple times if the bus could stop so she could use the restroom during the ride home from a Jan. 10, 2012 school field trip to a Chicago Wolves hockey game. Nakos said the bus driver called the dispatcher asking to stop but was denied, while teachers failed help.
Instead, teachers reportedly used coats to shield the girl and had her pee into a cup on the front steps of the moving bus full of kids. According the Sun-Times, Nakos said the bus eventually did stop so the girl could toss out the cup's contents.
Last year, a high school art teacher in San Diego was placed under investigation after a 14-year-old student claimed to have been forced to urinate in a bucket inside a classroom instead of taking a bathroom break.
That January, seventh grader in Houston, Tex., was similarly forced to urinate into a plastic water bottle when he was denied a bathroom break, according to a lawsuit.
The Wilmington School District 209Uis in a suburb roughly 60 miles southwest of Chicago.
